Unethical Behavior

    Anyone on the forum know the following person:

    AJ&T Contractor
    James Pool
    6625 Coral Ln
    Lolo, Montana 59847

    While I know the law states that you can keep anything a business sends you that you didn't order. I also understand that law is to prevent unethical behavior by businesses who would attempt to send you something and then try to make you pay for it. Not something that was done in this case. It was simply me being overworked and making a mistake when I put the labels on the packages. One customer jumped right on it, labeled the package with the forwarding label I sent them and got it right back in the mail, so this guy could get his product that he ordered, but this guy instead chose to keep the product he was sent, an EHC, and to hell with the other customer that was waiting for their EHC.

    Not that I expect anything to really happen but should you happen to know this guy maybe you could just mention to him that what he did is really unethical, can't really say theft as it was sent accidentally and there is a law to protect his unethical behavior, and he should ship the EHC back to us, as we have requested several times now, or at least pay for it. It's not like we're Amazon or some other huge Corp. that can afford these types of losses.

    Looks like the key is you aren't asking for him to pay but to send it back. Obviously he must be a customer of yours or you wouldn't have had his address. Seems like you pay shipping and he sends the unasked for part back.

    If he dont send it back....simple. Blackball his azz.....when he cant find parts maybe his ethics will return?

    I mean I can understand if something happened in his life that is taking all his time and concentration and he just can't get to putting it in the mail, I kind of doubt it, so I don't want to jump the gun and just call the guy a dirt bag thief but experience has taught me that the latter is more likely the truth.

    HMAN, your absolutely right. I hate doing that but sometimes principle is more important than money.
    PK, this was his first order. No never meant for him to have to pay for it just wanted him to forward it to the customer at the address on the label we sent him.
    It sucks and I feel like an idiot for screwing up the orders but shit happens in this world. We should all learn to be more forgiving and patient.

    I don't understand why anyone would do that. Hopefully something has come up and he's not able to ship it back or forward it and he'll make it right. I still have faith that most people are good and honest, even though it has been tested here lately. Surely he has enough time to call or send you a e-mail explaining his situation. I hope it turns out good for you Curtis. Good luck

    Bums me out because I need every dime I can get my hands on to keep finishing the shop and moving towards being able to produce parts on my CNC machines that no one makes for the BDs anymore as well as new ones we are designing.
    I figured it was worth a shot to mention it here just in case.
    I already suffered the wrath of the wife for doing something so stupid....lol.

    Try getting the postmaster at yours/his local post office or the courier service used. If you include a receipt with the package and you have proof of sale that this guy is not the intended recipient then maybe they could request he return it.

    That law is specific to unordered merchandise not incorrect shipments -- you probably have to eat the shipping but I'd check with a lawyer, especially since he has (if I read correctly) recieved what he ordered courtesy of the other client doing the right thing.

    Could be his job has him out of town for days at a time or longer, or possibly it is sitting at his workplace and is none the wiser about this issue. Just saying as sometimes I do not open mail or packages for weeks at a time. An ebay seller once sent the wrong part for a lighted flag mount and when I contacted me about getting the correct part and a return authorization to send wrong part back, he said keep it and new one will be on the way, then asked why I did not contact him 3 weeks ago when the part arrived, told him just got around to working on the rail and opened the package. Things happen, may just be in this case, may not be but good of you to take the high road and not come out with guns blazing...

    I still have my original EHC and it has been tested by you a long time ago to be satisfactory. I replaced it with Wire Plus so it won't go back in the 2008 Ridgeback.

    Like Kickstart, you are welcome to have it for free and I'll pay for shipping also.

    This is my way of saying your service is very much appreciated and I'll always support your business.

    Just let me know and know also that I'm probably not as quick as you on the shipping and delivery time. You're hard to beat.

    Appreciate all you folks on the forum. I'm really thankful that KnotSo has stepped up and we can all come to the forum to talk and discuss things without all the stupid crap that was going on before. This forum is a valuable resource for all BD owners and it was really discouraging before to watch what was being allowed to happen to it.
