ok so just talked to the dealer today and after replacing the clutch assembly, clutch plate and spring and installed a shim kit the bike continues to slip when passing someone at about 2500-3500. Does anyone know which direction I should tell them to go. Big Dog said they knew what the dealer needed (shim kit) and its still doing the same thing. Please help!!!!!!! the dealer has had my bike for over a month now and I'm getting pissed.

Sounds like clutch pushrod to me, my started slipping in all the gears, turn the pushrod clockwise till you feel tension then turn the other way 1/4 to 1/2 of a turn then sould be fine. Least that worked for me. Try that, and read up on this, alot of people have had the same problem.

whether this could be the problem or not, i do not know. remove the pushrod and check for signs of wear on the clutch end tip of the pushrod. they are case hardened and wear very well, but when they DO wear through the hardened tip, they wear fast and will not stay in adjustment. this could be another thing to check, worth a try. good luck.
